🇺🇸 United States

Do I legally need rules for an Instagram giveaway?
In most jurisdictions, yes — a public giveaway should publish official rules stating who is eligible, how to enter, the prize, the entry period and how the winner is chosen. Meta's own Promotion Guidelines also require you to acknowledge that the giveaway is not sponsored by Instagram.
What is the 'not sponsored by Meta' disclaimer?
Instagram/Meta requires every promotion run on its platform to include a release stating the promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram or Meta. The generator adds this clause automatically.
Why does 'no purchase necessary' matter?
In the US and many other markets, a prize giveaway that requires a purchase to enter can be treated as an illegal lottery. Keeping entry free (no purchase necessary) keeps it a sweepstakes/giveaway rather than a lottery.
